Probate litigation involves disputes between heirs to an estate.  The probate court is the system for transferring assets owned by a dead person to the living.  There are all types of litigation in this process.

There are will contests.  If a child was disinherited, the child can sue and ask the probate judge to rule that the deceased person was not of sound mind at the time the deceased person wrote the will.

Another type of case involves where the executor–or person in charge of administrating the estate, wants to recover assets.  An example is where the decedent gave one child $100,000.00 before the decedent died.  The executor will attempt to get this money back.
