Partition Suits

Sometimes two or more people own property together and they disagree about the management of the property. In that situation one can sue to partition the property. If the property can be divided, then the Court will divide the property. For instance if two people own 30 acres, then the Court will give each one 15 acres.

If the property cannot be divided, the Court will order a sale. The sale, if the parties cannot agree otherwise, will be conducted by the Sheriff to the highest bidder at a public sale. When the money is received, it will be distributed to the owners according to their interest in the property.
